TLDR (samenvatting voor de managers en HF-ers met een concentratiespanne van 7 seconden: NATO straps is door een patententrol als merk geregistreerd en maakt nu het leven zuur van webshops die bandjes aanbieden. Als ze geen doekoe geven aan die patententrol gaat die webshop op zwart.
Wat is een patenttrol? Volgens wikipedia is dat:
De term patenttroll wordt internationaal gebruikt voor veelal kleine bedrijven die zelf een octrooipakket opbouwen of beheren voor een groot bedrijf. Ze octrooieren ideeën maar produceren zelf niets. De octrooien worden ingezet om actief rechten af te dwingen. Patenttrolls worden publiek bekritiseerd omdat ze niets produceren en maatschappelijk dus niets bijdragen. Dit argument geldt echter met name voor de kleine patenttrolls die zelfstandig opereren
De patententrol International Watchman Inc heeft het dus voor elkaar gekregen om het woord NATO strap te patenteren. Hij maakt nu jacht op alle bedrijven die zonder zijn goedkeuring het woord NATO strap gebruiken. Dit oneigenlijk gebruik kan rechtgezet worden door een licentie bij hem af te nemen. Je dokt dan een x bedrag voor elke NATO strap die je verkoopt bijvoorbeeld. Of je betaalt een x bedrag om een of meerdere jaren de naam NATO strap te mogen gebruiken. Er zijn meerdere meerdere webshops die op zwart zijn gegaan omdat ze niet willen/kunnen betalen. Hieronder het relaas van het sympathieke bedrijf Cheapest NATO straps.
Ok, so this happened: a trademark troll somehow managed to trademark “NATO strap” although most of us would consider it to be a generic word for a watch strap that has been around for over 50 years now, and also had a couple of million google matches when registered.
This trademark troll is now trying to extort me into paying licensing fees for me to keep my brand name, and to be able to keep calling NATO straps by their right name.
I refuse to do so, and that caused a temporary shutdown of my webshop this last weekend. But fortunately, I was luckier than some other small business and watch strap artisans who had their sites and Etsy’s shut down, some of them weren’t even selling NATO straps. This really sucks, because it kills so much creativity. What is left is the generic, boring old straps that most vendors sell.
I started Cheapest NATO Straps 10 years ago with the same goal as I have now, to provide the best and largest collection of NATO straps at reasonable pricing. I have lost count of how many unique designs I have made over these years, but I try to average about 20 a month. More than most of my competitors make together over a full year.
Besides NATO straps, I have also put some effort into making more leather watch bands at a reasonable price. All leathers I sell now are full-grain leathers.
I really want to keep doing this, that’s why I am forced to change my business name from www.cheapestnatostraps.com to www.cnswatchbands.com
I would be eternally grateful if you could help spread the word or if you have any suggestions on how to get this trademark troll off of my back. And I would personally stay away from vendors that have a little quote at the bottom of their pages saying that International Watchman Inc owns the trademark, because the more vendors that are doing so, the more legitimacy that company gets, and it will be a lot more difficult it will be to get the incorrect trademark registration revoked.
